1. INTRODUCTION
1.1 These Terms and Conditions and any rules published by the GoAustralia Card from time to time (Club Rules) govern all aspects of the GoAustralia Card.
1.2 These Terms and Conditions form the basis of the GoAustralia Card. They are intended to protect you as a member of the GoAustralia Card.
1.3 In the event of any conflict these Terms and Conditions shall prevail.
1.4 Your membership in the GoAustralia Card will be governed by these Terms and Conditions and the Club Rules. It is your responsibility to read and understand them.
1.5 Each member of the GoAustralia Card is responsible for remaining aware of the Terms and Conditions and the Club Rules.
1.6 Every effort has been made to ensure the information provided to the member in relation to the GoAustralia Card is correct. However the GoAustralia Card accepts no responsibility for any inaccuracy or misdescription.
1.7 Our star ratings are only a guideline and are subject to change without notification.

2. DEFINITIONS
2.1 In these Terms and Conditions unless the context otherwise requires "benefits" or "preferred rates" means any of the facilities services and arrangements offered or available to the Member from time to time as a result of membership in the GoAustralia Card. "Card" means the GoAustralia Card membership card issued to the member. "Member" means the person whose name is printed on the Card and who is a member of the GoAustralia Card. "Partner" means those suppliers, which the GoAustralia Card has an agreement for the use of any facilities, details of which are notified by the GoAustralia Card to members from time to time. "Family Member" means a member at whose address an applicant for membership resides. "PIN" means personal identification number, which is issued at the time of joining, it is used for The World Exchange telephone service. "GoAustralia Card" means GoAustralia Card acn number 075 940 500. "Terms and Conditions" means those Terms and Conditions as amended from time to time.

3. CHANGES TO THE TERMS AND CONDITIONS OR CLUB RULES
3.1 The GoAustralia Card reserves the right to vary the club rules at any time without notice.
3.2 The Terms and Conditions and the Club Rules can not be superseded or changed except in writing by the GoAustralia Card.
3.3 The GoAustralia Card shall use all reasonable endeavours to advise Members of any changes in the Terms and Conditions or the Club Rules but, shall not be liable in any way for failure to do so.

4. MEMBERSHIP
4.1 Should you indicate to us within two (2) weeks of paying the joining fee that you would like.to withdraw from being a GoAustralia Card member we will cancel your membership and refund your money. Naturally, if you decide to use your membership at any time within the 14 days it will be assumed that you agree to abide by these Terms and Conditions.
4.2 Applicants may enrol for any type of membership listed in item 5 below, provided applicable services are satisfied.
4.3 Upon acceptance of enrolment in the GoAustralia Card each member will be assigned a Membership number and a Personal Identification Number (PIN), along with date of birth which will be used for security of membership identification. It is the member's reasonability to ensure the card and the PIN is kept secure.
4.4 Individual members must enrol separately and may only hold one membership for the GoAustralia Card.
4.5 Each member shall be responsible for advising the GoAustralia Card of any change of name or address or loss of card. This must be supplied in writing.Verbal notification is not valid.
4.6 Membership will terminate automatically on the death of a Member.
4.7 Membership is non-refundable, and except in the case of Family Membership as specified in these Club Rules is not transferable.

5. TYPES OF MEMBERSHIP
5.1 Individual membership is open to individuals other than employees of the GoAustralia Card or anyone also not entitled, who are over 18 years of age and is not transferable.
5.2 Family membership consists of 2 adults and 2 children and is only available to immediate family members who are 18 years or less. Those individuals will have a common expiry date and their membership is not transferable. More than 2 children can only receive a discount at the discretion of the service or product provider.

6. USE OF THE CARD
6.1 By use of the Card the member agrees to be bound by the Terms and Conditions.
6.2 The Card is and shall remain the property of the GoAustralia Card and must be returned on demand. It is not a credit card.
6.3 The Card is valid for use only by the Member whose name the Card is registerred to.
6.4 The Card is valid for use only during the period indicated on it.
6.5 The GoAustralia Card expressly reserves the right in its absolute discretion to withdraw, cancel, withhold, deny access to, or use of, or in any way change the membership. Furthermore any of the benefits previously advertised or offered generally or to any member at any time, the GoAustralia Card will not be liable for any loss or damage suffered by the Member resulting from such withdrawal, cancellation, variation or change.
6.6 In the event of loss or theft of your membership card, it is your responsibility to immediately advise the GoAustralia Card or if outside Australia your local GoAustralia Card office.The GoAustralia Card will not be liable for re-issue of a lost Membership Card.

7. LOST OR STOLEN CARD
7.1 If the card is lost or stolen, the member must notify the GoAustralia Card in writing immediately and must be able to supply details and/or verification of loss or theft of the Card if required.
7.2 Replacement Card fee/waivers: a request for the waiving of replacement fee can be made under the following circumstances:
7.3 Change of name due to marriage(relevant documentation required).
7.4 Stolen card( Police report or reference number required and location of police station where reported)
7.5 Card not received from the GoAustralia Card: lost in the mail (statutory declaration required)

8. SERVICES OF THE GOAUSTRALIA CARD
8.1 Some of the benefits offered to the Member are provided by partners over which the GoAustralia Card has no control. Arrangements for the availability and the utilisation of the benefits so offered are made by the GoAustralia Card solely as agents for the partners providing such benefits The provision of the benefits will be subject in each case, to the Terms and Conditions of the Partners providing such benefits which shall constitute the sole contract between the provider of the benefits and the member.
8.2 The GoAustralia Card will not be liable for refusal of any partner of the GoAustralia Card benefits to accept or honour the Card nor will the GoAustralia Card be liable for any loss or damage whatsoever whether in whole or part or any benefits.Any complaints made by the Member must resolved solely with the said Partner of the benefits.
8.3 Whenever the card is used in order to obtain or utilise benefits, or benefits are made available to the member as a result of membership, whether these are provided by the GoAustralia Card or a GoAustralia Card Partner.The Member will be liable for any or all costs, charges,taxes,claims or liabilities of whatever nature and howsoever arising from or incurred in connection with obtaining or utilising the benefits.

9.TERMINATION
9.1 The GoAustralia Card expressly reserves the right to terminate or materially alter the operation or benefits of the GoAustralia Card at any time without notice.
9.2 GoAustralia Card reserves the right at any time in its absolute discretion and without notice to evoke the membership of the Member to use the card. In the event the Card is evoked a prorata refund will be made of the membership fee paid by the Member at the GoAustralia Card discretion.The card must be returned immediately to the GoAustralia Card when so demanded by the GoAustralia Card .
9.3 Any breach of the Terms and Conditions whether intentionally or otherwise may result in termination of membership cancellation of benefits,or both at the sole discretion of the GoAustralia Card.
9.4 It is a breach of the Terms and Conditions for any Member in the reasonable opinion of the GoAustralia Card to:
- Abuse any facilities, services or arrangements accorded to the member as a result of membership in the GoAustralia Card
- Act in any way which is likely to be detrimental to the interests of the GoAustralia Card or any Partner
- Supply or attempt to supply misleading information or make any misrepresentation to the GoAustralia Card or any Partner

10. GOVERNING LAWS
10.1 These Terms and Conditions shall be governed and construed in accordance with the laws of the State of N.S.W. Australia irrespective where the application of Membership has been completed by the Member or submitted to The GoAustralia Card and any action or other legal process with respect to any matter or thing in contention therewith against the GoAustralia Card shall unless otherwise agreed by The GoAustralia Card be instituted and carried on only in the appropriate court of the State of N.S.W.
